A six-year sentence handed down in a deadly head-on crash in Calgary nearly three years ago will stand.
Kelly James York was appealing the sentence after he pleaded guilty to impaired driving causing the death of Tony Harrison in July 2012.
The motorcyclist was hit when York’s van crossed the centre line.
York walked away from the scene, but was later arrested and court heard he was three times the legal alcohol limit.
In a 2-1 decision, the Alberta Court of Appeal dismissed York,s argument that his punishment was unduly harsh.
